LICENCE AGREEMENT

Use of Phoenix Financial Management System, Phoenix Farm Management or Phoenix Farms hereinafter called "Phoenix" is subject to this Licence Agreement.

BEFORE REGISTERING THE PHOENIX PROGRAM, PLEASE READ THIS LICENCE AGREEMENT.  BY REGISTERING THE PROGRAM YOU SIGNIFY THAT YOU HAVE READ THIS AGREEMENT AND ARE AGREEING TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.

IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS LICENCE AGREEMENT, DO NOT REGISTER THE PROGRAM. Instead, return to the place of purchase the software disks together with any manual, binders, and other written material received.

TERMS  &  CONDITIONS

AGDATA Australia Pty Ltd, hereinafter referred to as "AGDATA", has agreed to supply Phoenix to the person, association, or corporation whose details have been supplied to AGDATA on the registration form supplied with this Phoenix system hereinafter called the "Registered User".

The Registered User is granted the right to use one copy of Phoenix on a single computer hereinafter called "the Authorised computer".

Phoenix is supplied for installation onto the Authorised  computer only, and the Registered User shall ensure Phoenix is not installed or copied onto any computer other than the Authorised computer.

Phoenix may not be transferred, in any form, to an unregistered or unlicensed user.  It is illegal to make or distribute copies of this software except to make a backup copy for archival purposes only.  Duplication of this software for any other reason including sale, loan, rental, or gift is illegal. Phoenix is supplied expressly for the management of the Registered User`s financial, trading and production data only.

UNDER THE TERMS OF THIS LICENCE, THIS COPY OF PHOENIX MUST NOT BE USED TO RECORD OR CREATE THE FINANCIAL, TRADING OR PRODUCTION DATA BELONGING TO ANY OTHER PERSON, COMPANY, OR ORGANISATION.  A separate licence agreement must be obtained from AGDATA to create and record financial, trading or production information for  another party.

By agreeing to these terms, Phoenix Mapping users also agree to be bound by the Google Maps Terms of Use.

Phoenix Gateway is Copyright (C) 2006-2010 by AGDATA Australia Pty Ltd, 122 Russell Street, Toowoomba Qld 4350, Australia.  The program code of Phoenix is copyright and always remains the sole property of AGDATA Australia.  You may not adapt, disassemble, decompile, or reverse engineer the Phoenix software.

The manual and all other written material supplied as a part of the Phoenix package are subject to copyright. No part of the documentation may be reproduced, stored in a retrieval system, or transmitted in any form without the prior written permission of AGDATA Australia.

Disclaimer

Under no circumstances will AGDATA be liable under any warranty, statutory or otherwise, in respect of any defect, failure, omission or any other deficiency in the program or the operation thereof caused by or contributed to by use of this program in conjunction with any equipment in any configuration or network or in any environment exceeding or otherwise inconsistent with those approved in writing or prescribed by AGDATA.

AGDATA Australia shall not be liable for any loss or damage suffered by the Registered User arising as a result of the failure by the Registered User to follow and observe the installation and operation instructions supplied with the Phoenix package. 

AGDATA Australia may make available access to third party image servers for use within the Phoenix software, however does not warrant nor guarantee the continuity of service and that access can be withdrawn at any time without notice.

Installation Re-registration

Phoenix may be re-registered on a replacement computer or in the event of significant changes being made to your existing computer.  In either case this program may become unregistered.  

This will require the generation and issue of a new registration number.  In this case, contact AGDATA and an Installation Change Request Form will be faxed to you.  On the completion of this form the replacement registration will be faxed back ASAP.  A small administrative charge may apply.
