- a party includes that party’s executors, administrators, successors and permitted assigns;
- a document is to that document as amended, novated or replaced from time to time;
- “including” and similar expressions are not words of limitation;
- a statute, regulation or provision of a statute or regulation (“Statutory Provision”) includes:
- that Statutory Provision as amended or re-enacted from time to time; and
- a statute, regulation or provision enacted in replacement of that Statutory Provision, or if relevant, the predecessor to that statute, regulation or provision;
- where a word or expression is given a particular meaning, other parts of speech and grammatical forms of that word or expression have a corresponding meaning;
- if a party consists of more than one person, this Notification applies to them jointly and each of them severally;
- headings are for convenience only and do not affect the interpretation or form part of this Notification;.
- words defined in the Privacy Act have the same meaning in this Notification.

We collect or have collected Personal Information about you to assist us with our purposes, functions and activities.
We collect Personal Information in a number of ways. For example, we generally collect Personal Information directly from you such as through the completion of a form, when you place an order with us, register or activate a product or product trial with us, apply for or attend training programs with us, in a document, verbally, in a meeting or interview, by email, by a digital device and other electronic means. If you are a current or prospective client of ours, when you perform actions within your products or applications or if you are a member of our authorised partner programs. When you use our website or Phoenix systems, we may collect information about your IP address, location or activity.
In some circumstances we may collect Personal Information about you from a third party. For example, we may collect information about you from:

- an associate;
- an advisor, including:
- an accountant;
- a financial planner;
- an insurer;
- a broker;

6. Artificial Intelligence (AI) & Automated Decision-Making Software (ADM)
If you are a client or prospective client of ours, we may use Personal Information for the purposes of developing and training AI tools for use within our business. This excludes information contained in datasets, unless provided by you as our client or prospective client for the purposes of providing support to you.
We may use ADM software to record file notes or summarise meeting notes. Our Privacy Policy sets out what type of personal information we use in ADM software and what types of decisions we make with ADM software (if any).
We may use ADM software to:
- assist us in making decisions about recruitment, employee management, dispute resolution and our general business operations; or
- solely make a decision in relation to recruitment where we may screen prospective employees through a third-party recruitment website.
- review and respond to customer support request;
- enable a customer or a person authorised by a customer to upload a document to our system which may then extract information and use it in that customer’s data structure to create a transaction in their software.

- use Artificial Intelligence (AI) to train our systems or tools;
- respond to your enquiry, request or complaint;
- conduct market research;
- take any required legal action;
- run our business and perform administrative, legal and operational tasks;
- conduct marketing and business development;
- chase a payment you owe us and if we think it is appropriate, report you to a credit reporting body;
- comply with our obligations under applicable laws, regulations and codes; and
- cooperate and liaise with an information match agent or intermediary in relation to verification of identity and administration of a document verification service;
- liaise with a related entity of ours including our parent company Arcadea AG Holdings Pty Ltd ACN 684 061 916 and Arcadea Group LLC (Parent Company) and any subsidiaries of the Parent Company and their officers and employees; and
- create reports including a State of the Industry Report.
8. Main Consequences if All or Some of the Personal Information Is Not Collected
If we do not collect your Personal Information or you do not provide your Personal Information to us, we may not be able to:
- assist you or an entity you are involved or associated with;
- provide you with information, a service or a product;
- verify your identity;
- carry out one or more purposes for which we collect, use, hold and disclose personal information.

- you may seek the correction of Personal Information we hold about you;

- we may deal with such a complaint.
Our Privacy Policy also contains information about Direct Marketing and how we use and disclose your personal information for direct marketing. If you wish to opt-out of direct marketing communications, you may do so at any time by:
- clicking the ‘unsubscribe’ link at the bottom of any of our direct marketing communications;
- clicking the ‘opt out’ link in any SMS messages, or by replying ‘STOP’ to the SMS message received;

We may disclose Personal Information about you to overseas recipients, for instance, when storing Personal Information with technology service providers which are situated outside Australia. We will endeavour to only disclose Personal Information to overseas service providers when it is necessary for the services they provide to us.
